E-cigarette companies have filed over 60 lawsuits challenging the FDA’s marketing denial orders. In addition, while the FDA denied marketing applications for all Juul products in June 2022, it subsequently put that decision on hold in the face of a lawsuit by Juul. When e-cigarette products first became popular, we didn’t have much information about health risks.

"If there was good evidence that people were using e-cigarettes just to quit smoking, there would be wide support," Benowitz says. Juul’s C.E.O., Kevin Burns, who is fifty-four, has a friendly dad-who-loves-his-vacation-house demeanor. Burns described Juul to me as a "cigarette-killing company." Before he accepted the job, he said, he convened an informal focus group in his kitchen with his son, who’s in high school, and a few of his son’s friends. He asked them why they had these things, when they got them, how prevalent they were. "We have frustrations about how the product is glorified on social media," he told me. The most important points to know are that the long-term health effects of e-cigarettes are still unknown, and all tobacco products, including e-cigarettes, can pose health risks to the user. The tobacco industry has co-opted the term harm reduction to further its own interests of reduced tobacco product regulation and expand its user base. E-cigarette use among adults has been more stable, with adult use remaining relatively low since around 2012. Recent data, however, showed a slight uptick in adult e-cigarette use from 4.5% in 2021 to 6% in 2022. Many grants on this topic are funded through the Tobacco Regulatory Science Program, an NIH partnership with FDA’s Center for Tobacco Products to fund research to inform FDA’s tobacco regulatory activities. The Centers for Disease Control and Prevention reports that nicotine can also harm parts of the brain that control attention, mood and impulse control. Founded in 1913 as the Harvard-MIT School of Health Officers, the School is recognized as America’s oldest professional training program in public health. This study explored the prevalence of S-SM, S-EC, and S-SN among adolescents in a country with advanced tobacco control regulations. We found that the susceptibility was highest for e-cigarette use, followed by smoking and snus use. S-SM was more common among girls, whereas S-EC and S-SN were more common among boys. In our analysis, levels of carbonyls were considerably reduced relative both to other studies of e-cigarettes and to Ky1R6F cigarette smoke.

While vape products are not covered by the Smoke-free Air Act, each business can prohibit the use of vape devices indoors, but this is not required by state law. Altria Group chief executive William Gifford told analysts during a second-quarter conference call that makers of unregulated e-cigarettes are responding to consumers’ switching to nicotine pouches.
